Air Charter Service Agreement

Operator`s name Part 135. (CARRIER) makes available to charter traffic described below the general terms of sale that are part of this agreement, in accordance with the provisions below and the terms and conditions of sale added to it. 20.2 To this end, the charterer authorizes the airline to retain and use personal data and to pass it on to companies involved in the provision of transportation or related services and facilities, to data processors working for the airline, airline agents, law enforcement authorities, credit cards and payment cards. This may involve the transfer of personal data outside the European Economic Area. 1.02 AGENCE MATTERS. (a) This agreement exists only between BlackBird and CHARTERER and no agency relationship is established or contemplated. Neither party has the authority to act on behalf of the other party, to represent the other party or to the other party`s commitment under this agreement. (b) No passenger is considered a contracting party to this agreement or has no rights. (c) Each party guarantees that its respective signatory has the right to execute this agreement and thus binds the party concerned to the agreement. The intermediary encourages the airline (as defined below) to make the aircraft available to the charterer in accordance with the schedule below, and the charterer flies from the intermediary on charter to the terms set out in the following list and in the terms and conditions attached to this agreement and participate.

15.1.1 20% of the charter price with immediate effect (For the exclusive use of the Charter passenger aircraft – between charterer and broker as intermediary) 3.01 AFFRLATE PRICE – DEFINED. Unless otherwise stated in this agreement, the charter price includes all operating costs of the aircraft on the intended route, as well as incidental costs, such as fuel, on-board equipment and catering, air and air assistance, aircraft maintenance, navigation and overflight charges, airport charges, crew costs (including salaries, hotel and ground transfers), carrier liability and hull insurance, and taxes and royalties, other than fees collected by each passenger. The charter price does not include, if applicable, (i) U.S. domestic transportation taxes, U.S. segment taxes, U.S. security taxes, U.S. arrival taxes, U.S. customs usage duties, U.S.

agriculture (APHIS) user fees, passenger transportation (PFCs) and taxes, taxes or taxes; (ii) transport of people, accommodation or services before departure or after arrival; or (iii) anti-ice/de-icing costs in section 3.03.
